We welcomed Michael Listner back to the show for a 116 minute discussion.  Michael started the discussion by talking about the upcoming first meeting of the National Space Council.  Michael said it looked as if it would be a good meeting on Oct. 5th, he talked about the history of the National Space Council and he mentioned some of the key people on the current Council.  He was upbeat and positive that the Council would lead to good US space policy.  We also had a short discussion about the nominated but not yet confirmed proposed NASA Administrator.

Next, Michael talked about the one day event sponsored by the Univ. of Nebraska Space, Cyber, and Telecommunications Law Center.  The event, "Outer Space as a Commercial Domain and Warfighting Domain: Emerging Issues In Space Law," was of great interest to Michael and he discussed many of the panels and many of those both attending and speaking as part of the panel presentations.  He highlighted the commercial space panel and the focus on safety issues and risk minimization.  Michael continued to tell us about many of the private discussions he had at the event with those attending and those speaking so this was a most interesting discussion.  Note that several of the people he mentioned will soon be guests on The Space Show.

We took a critical email about the Deep Space Gateway project which BJohn in Sweden clearly does not like.  I read his note to Michael who was not that familiar with the project but did respond to BJohn.  I suggested that BJohn's assumptions were a bit off though at this point nobody could ascertain the actual value and utility of the project.  I did not agree with our listener regarding the value of the project. 

Another topic Michael talked about with us focused on the issue of space safety for the crew.  In addition, space rescue law was talked about, then he talked about commercial space law in other countries and new national space agencies coming on line in New Zealand, the UAE, Australia, what was going on in Luxembourg and elsewhere.  This let to my asking Michael about UN meetings coming up to discuss modifying the Outer Space Treaty in terms of property rights, asteroid mining, and similar issues.  Don't miss what Michael had to say about these efforts.

Burton from Canada sent in a note about the Musk comments on Point to Point transportation using the BFR Mars rocket.  He wanted to know about rules, regulations, and such for both countries on each end of a point to point rocket flight.  Both Michael and I commented on point to point rocket travel between Earth cities so don't miss this discussion.

Other topics discussed before the program ended including more on the new Australian space agency, developments with the Canadian Space Agency, more on Article 6 and Article 9 of the Outer Space Treaty.  Michael mentioned different views and perspective by various space attorneys and he let us know where his views differed from their views.  We even took a listener question asking about the status of the Moon Treaty and impact it might have on commercial space development.   Michael mentioned the Netherlands in the Moon Treaty discussion, the I asked him about space in Mexico.

Before the program ended, Bob sent in a note asking if the loss of the Republican Congress to a new Democratic Congress would impact our space policy.  Michael did not think there would be a significant impact if that happened given the bipartisan nature of space.  Listen to what he said and let us know if you agree by posting your thoughts on the blog. 

In closing, Michael talked about the movement to preserve Apollo landing sites and he talked about the efforts underway to do that, mentioning two different approaches.  Listen to what Michael had to say on this issue.
